Abstract:

Drawing on the contributions of Klaudia Kurcani and Gabriele Torelli, this article raises two questions concerning Italian infrastructure law. The first addresses the relevance, within the Italian legal order, of the concept of State responsibility for infrastructure, as developed by German public law scholarship. The second question concerns the extent to which negotiation and conflict management techniques – traditionally employed in other contexts – may be applied to disputes between public authorities arising in the context of the approval and siting of infrastructure projects.

Prendendo le mosse dai contributi di Klaudia Kurcani e Gabriele Torelli, nello scritto vengono formulati due interrogativi sul diritto italiano delle infrastrutture. Il primo riguarda l’utilizzabilità nell’ordinamento italiano del concetto di responsabilità statale per le infrastrutture, elaborato dalla dottrina giuspubblicistica tedesca. Il secondo concerne invece la possibilità di applicare tecniche di negoziazione e di gestione dei conflitti – tradizionalmente impiegate in altri contesti – alle controversie interamministrative in materia di approvazione e localizzazione delle opere infrastrutturali.
