Abstract:
The article examines the evolution of the regulatory framework governing public contracts, as well as the prospects for establishing a special regime for projects financed with European funds. Its aim is to offer a comprehensive reading of recent reforms, highlighting the tension between the need for faster procedures and the preservation of procedural safeguards, and identifying possible solutions to make a model that balances efficiency, transparency, and the legality of administrative action. In particular, it analyzes the temporary measures introduced to accelerate and simplify the implementation of works and infrastructure funded through the NRRP and other European resources, taking into account the emergency tools that were first adopted to address the pandemic and later adapted to support economic recovery. The focus then turns to the reform of the Public Contracts Code and the innovations it introduces, starting with the codification of general principles. It also considers the new regulatory framework for strategic infrastructure, while noting that projects financed under the NRRP remain subject to the fragmented system of derogations established by earlier decrees. Finally, the article suggests incorporating and streamlining within the Code the acceleration measures adopted to ensure the effective use of NRRP resources, allowing for the coexistence of two special regimes alongside the ordinary one: one for strategic infrastructure and another for projects financed with European funds.
L’articolo è dedicato all’analisi dell’evoluzione normativa nel settore dei contratti pubblici, nonché alle prospettive di stabilizzazione di un regime speciale per le opere finanziate con fondi europei. L’obiettivo è fornire una rilettura complessiva dei recenti percorsi di riforma, evidenziando le tensioni tra accelerazioni e garanzie procedimentali e delineando possibili soluzioni per rendere strutturale un approccio che concili efficienza, trasparenza e legalità dell’azione amministrativa. In particolare, si esaminano le misure normative provvisorie di accelerazione e semplificazione per la realizzazione di opere e infrastrutture finanziate con il Pnrr e altre risorse europee, dando conto degli strumenti emergenziali che si sono sovrapposti prima per affrontare l’emergenza pandemica e poi per favorire la ripresa economica. L’attenzione si sposta poi sulla riforma del Codice dei contratti pubblici e sulle innovazioni introdotte, a partire dalla codificazione dei principi. Si prende in considerazione la nuova disciplina codicistica delle infrastrutture strategiche, dando però conto del fatto che le opere finanziate dal Pnrr continuano a essere sottoposte al frammentato regime di deroghe introdotto dai decreti precedenti. Si propone infine di sistematizzare e razionalizzare, all’interno del Codice, le misure di accelerazione dei lavori pubblici dettate ai fini dell’assorbimento delle risorse Pnrr, in modo che convivano due regimi derogatori rispetto a quello ordinario, ossia quello delle infrastrutture strategiche e quello delle opere finanziate con fondi europei.
