Abstract:
The Italian Court of Auditors has gradually become the only court empowered to exempt the (public) party from liability for damages even in the presence of a clear causal link between human conduct —that of the agent— and the harmful event, due to a specific legislative choice to limit the legal liability of those who exercise the property rights of the public administration. Only in the context of administrative liability—and, by contrast, in criminal law—are there significant limits placed on the judge’s discretion in assessing conduct, established through the predefined subjective element, that is, intent or negligence.
