Abstract:
This article examines the rule preventing State courts from annulling sporting sanctions. It challenges the idea that monetary compensation strikes a reasonable balance between the autonomy of the so-called ordinamento sportivo and athletes’ right to judicial protection. More specifically, the article pursues two objectives. First, it argues that compensatory relief alters rather than preserves the balance of interests created by the sanction. Second, it questions the assumption that sports federations would invariably prefer to pay monetary compensation rather than have their disciplinary decisions annulled.
